Retirees Group Welfare Benefit Trust Of El Paso Electric Company

El paso electric company ("epe") has adopted the comprehensive medical plan for the retired non-union employees of epe (said plans as they presently exist together with any amendments thereto hereafter made, being hereafter referred to as the "plan") for the benefit of its former non union employees who have retired from epe. in order to comply with the public utility commission of texas ("puct" substantive rule 23.21 relating to post-retirement benefits other than pensions, and in accordance with the puct final order effective february 12, 1996 with respect to epe, epe has established the retirees group welfare benefit trust (veba trust), a tax-exempt trust fund under internal revenue code sections 501(c)(9), to which contributions may be made by epe, and from- which payments may be made to satisfy all or a portion of the benefits payable under the plan to non union retirees from epe, their beneficiaries or estates. the veba trust is administered by the benefits oversight committee ("committee"), which has been appointed by epe.In addition, effective february 1, 2020, the plan sponsor and plan administrator amended the plan and restructured the plan's veba trust fund into four separate trust funds (three veba arrangements, and a 401(h) account). the restructuring did not modify plan benefits offered to non-union retirees.
