It also pursues legislative and regulatory changes that seek to benefit children with cancer and at the same time to raise awareness of issues involving pediatric cancer in addition, the foundation also donates limited funds to other 501(c) (3) charities not directly related to pediatric cancer causes but assist the foundation in its mission stated above.\n\n6. Max cure foundation's jonathan agin, executive director, and richard plotkin, vice chairman and co-founder, have been over the last several years and continue to be among the nation's leading advocates for children with cancer. In 2014, mcf officially added advocacy to its mission to advance the cause of childhood cancers. Mcf has been in the forefront of the childhood cancer advocacy community since 2011 by relentlessly pursing legislation and regulatory changes that seek to benefit children diagnosed with cancer and at the same time, to raise awareness generally of issues applicable to childhood cancer. A. Of particular significance in 2014 was the case of josh hardy. Josh had experienced four bouts of kidney cancer from the age of 9 months and in january 2014 at the age of 7, had a bone marrow transplant which resulted in his being diagnosed in mid-february with a life threatening adenovirus given that his immune system was totally compromised. The available medications which had been approved by the fda and which were used in josh's treatment were not working and as of march 7, 2014, he was given two weeks to live unless, according to his treating doctors, he was given an experimental drug known as brincidofovir which was manufactured by chimerix, a bio tech firm in north carolina. B. Chimerix declined the request by josh's treating doctors to give josh the drug consistent with its having declined since 2012 over 300 prior requests for the drug by terminally and seriously ill patients. Mcf agreed on march 7, 2014, to attempt to get the drug for josh which hopefully would save his life. C. Ultimately, due primarily to the efforts of mcf, josh on march 12, 2014 received the drug which is credited with saving his life. When the former ceo of chimerix is asked what distinguished josh hardy from the over 300 requests by seriously and terminally ill patients that the company declined, he advised that he answers in two words, referring to the foundation's vice-chairman, \"richard plotkin.\" josh's health continued to improve over the 2.5 years following his being given the drug. Josh, at age 10, died on september 22, 2016 from complications caused by the cancer he had battled since he was 9 months old. D. In an article appearing in the boston globe magazine on july 19, 2015 by sylvia pagan westphal titled, \"sick kids, desperate parents, and the battle for experimental drugs,\" the author, with reference to the events which led to the saving of josh's life, said: \"the family was introduced to richard plotkin, [characterized in the article as \"an aggressive patient advocate who masterfully choreographed a pr siege against the company\"], a former litigation lawyer who heads the max cure foundation, which he founded after his grandson was diagnosed with lymphoma. With the same relentless energy once deployed in the courtroom, plotkin plunged headlong into the hardy cause, directing its pr campaign.\" see also an article in the june, 2016, issue of harper's magazine entitled, \"hashtag prescription, the hidden cost of crowd-sourcing a cure\" which discusses richard's role in this seminol case involving josh hardy. The experimental drug, as noted, cured the adenovirus afflicting josh. Sadly, though, as noted, on september 22, 2016, josh, at age 10, succumbed to the cancer that had afflicted him for his entire life. In 2014, mcf's vice president, richard plotkin, was appointed to an advocacy committee dealing with the white house on issues relating to pediatric cancers. He has also been interviewed on national public radio (npr) and on cbs radio regarding his role in the josh hardy matter. In addition, richard has been invited to participate in panel discussions at various industry conferences and has been a featured speaker at other times to various audiences, all of which dealt with his efforts to save the life of josh hardy and how his efforts were successful when those requests from over 300 prior patients' requests for brincidofovir were denied. This included a presentation in february 2015 at harvard medical school where he spoke on the issue of the legal and ethical issues arising out of the josh hardy matter. Richard was appointed in july 2014 as the national pediatric cancer advocate on a committee formed by nyu langone medical center, department of ethics, to determine, as a result of the josh hardy matter, if the rules and regulations established by the fda to allow drug manufacturers to dispense unapproved drugs to terminally and seriously ill patients under what is known as expanded access/compassionate use needed to be revised. Richard is also a member of the advisory council formed by another foundation that established a navigation system for families to attempt to obtain experimental drugs for their terminally ill children, among other patients. During the last quarter of 2014, richard was consulted by congressman michael mccaul in connection with legislation congressman mccaul would be proposing to congress dealing with the expanded access/compassionate use issues arising out of the josh hardy matter. That legislation, sponsored by congressman mccaul, was included in 21st century cures act and the star act, the former of which was signed into law on december 13, 2016. Richard has also been consulted by the government accountability office (gao) with respect to a study being done for congress relative to the dispensing of experimental drugs to terminally ill and seriously ill patients. Moreover, in early 2014, prior to mcf's involvement with josh hardy, mcf (through richard plotkin) was credited with obtaining from the fda the first ever compassionate use waiver for a combination drug therapy for a child with cancer in the form of an unapproved drug to be combined with two approved drugs. Despite mcf's efforts here, the child passed away from his cancer the same day, march 12, 2014, that josh hardy was given the life - saving drug, brincidofovir. This demonstrates the \"hills and valleys\" experienced by mcf in its efforts to save the lives of children with cancer. Jonathan agin, an attorney, joined the mcf team in 2015 as executive director. Jonathan has been a leading advocate for pediatric cancer causes since the death in january 2011 of his four year old daughter, alexis, to a rare form of childhood cancer. Jonathan's advocacy work has encompassed many facets of the fight against childhood cancer. His legislative advocacy has proven effective in the passage of several bills in a climate of congressional stagnation. Along the way, following alexis' death, jonathan began to write and speak on issues impacting the childhood cancer community. Jonathan frequently interacts with members of congress and their staff, the white house, as well as various regulatory agencies and other cancer foundations in an effort to improve the plight of children with cancer. A frequent contributor to the huffington post, editor for the canadian oncology journal known as the cancer knowledge network and as a guest writer in other media outlets, jonathan has quickly become one of the most trusted voices in the childhood cancer community. Jonathan sits on the national cancer institute brain malignancy steering committee as one of two patient advocates assessing phase ii and phase iii pediatric and adult clinical trials. In 2017, richard and jonathan were actively involved in opposing on the federal level before congress (both in the senate and in the house of representatives) what is known as the right to try law. Right to try laws had been passed in 38 states at the urging of the goldwater institute, a libertarian public policy think tank. Richard and jonathan argued the law was not necessary and indeed, harmful to terminally ill children and their families. They argue that, among other things, to remove the fda from the approval process in delivering investigational drugs (drugs not approved by the fda) to terminally ill patients, including terminally ill children with cancer, would be a gross mistake. Richard published two articles in the hill.com, the first in opposition to senate bill (s. 204) which passed the senate in 2017 and the second in opposition to the house bill (h.r. 5247) which was pending as of the end of 2017 and was voted on by the house in 2018. See \"'right to try' is a sham\" [http://thehill.com/blogs/congress-blog/healthcare/319171-right-to-try- and \"'right to try' continues to be a sham\"[http://thehill.com/opinion/healthcare/377989-right-to-try-continu by richard plotkin on february 17, 2017 and march 12, 2018, respectively. Jonathan likewise published an article in opposition to h.r. 5247 titled \"right to try: a significant setback to drug development for childhood cancer\" [https://cancerkn.com/right-try-significant-setback-drug-development-ch on march 13, 2018 in the cancer knowledge network.","year":2017,"name":"THE MAX CURE FOUNDATION INC","phone":"2015695595","website":"MAXCUREFOUNDATION.ORG","type":"990","principal_officer":"RICHARD PLOTKIN","year_formation":2008,"state_legal_domicile":"DE","total_volunteers":25,"tax_period_begin":"2017-01-01T00:00:00","tax_period_end":"2017-12-31T00:00:00","address":"560 SYLVAN AVE NO 1225, ENGLEWOOD CLIFFS, NJ, 07632, USA","city":"ENGLEWOOD CLIFFS","state":"NJ","country":"USA","zip_code":"07632"},"Governance":{"501c3 determination":true,"Number of voting members":9,"Number of independent voting members":8,"Number of employees total":3,"Total Gross UBI":0,"Net unrelated business taxable income":0,"Number of employees":3,"Prohibited tax shelter transactions":false,"Taxable party notification":false,"Premiums Paid":false,"Family or business relationship":true,"Delegation of management duties":false,"Conflict of interest policy":true,"Whistle blower policy":true,"Compensation process for CEO":true,"Compensation process for other employees":false,"Changes to organizing documents":false,"Material diversion or misuse":false,"Members or stockholders":false,"Election of board members":false,"Decisions subject to approval":false,"Minutes of governing body":true,"Local chapters":false,"Form 990 provided to governing body":true,"Document retention policy":true,"Investment in joint venture":false,"Independent audit financial statements":true,"Consolidated audit financial statements":false,"Accountant compile or review":false,"Financial statements audited by independent accountant":true,"Audit committee":true,"Federal grant audit required":false,"Audited financial statements separate":true,"Political activities":false,"Donor advised funds":false,"Conservation easements":false,"Collections of art":false,"School":false,"Hospital":false,"Foreign activities":false,"Foreign office":false,"Gaming":false,"Fundraising activities":true,"Professional fundraising":false,"Loan to officer or DQP":false,"Grant to related person":false,"Business relationship through family member":false,"Business relationship with organization":false,"Transfers to exempt non-charitable organization":false},"Revenues":{"value":796293,"Contributions":{"value":638256,"Other contributions":552045,"Fundraising revenue":86211},"Program revenue":{"value":0},"Investment income":{"value":0},"Other revenues":{"value":158037,"Other total":219361,"Net income from fundraising events":-61324}},"Expenses":{"value":609633,"Grant expense":{"value":230575,"Grants to domestic orgs":112400,"Grants to domestic individuals":75675,"Foreign grants":42500},"Total professional fundraising expense":{"value":0},"Benefits paid to members":{"value":0},"Salaries":{"value":133155,"Current officers":72000,"Other salaries and wages":44400,"Other employee benefits":6348,"Payroll taxes":10407},"Other expenses":{"value":245903,"Management services":15484,"Legal":59787,"Accounting":17660,"Advertising":69899,"Office expenses":2055,"Information technology":6963,"Occupancy":24190,"Travel":6890,"Depreciation and depletion":1431,"Insurance":4681,"Itemized Expenses":{"value":30250,"MISCELLANEOUS":10265,"BANK CHARGES":8135,"ADVOCACY":6308,"COMMUNICATION":5542},"All other expenses":6613},"Functional Expenses":{"Program Service Expenses":314959,"Management And General Expenses":188119,"Fundraising Expenses":106555}},"Assets":{"value":226372,"Non-interest bearing cash":134582,"Pledges and grants receivable":15000,"Accounts receivable":72400,"Land, building, equipment":595,"Other assets":3795},"Liabilities":{"value":14501,"Accounts payable, accrued":11692,"Other liabilities":2809},"Fund balance":{"value":211871,"Unrestricted net assets":208971,"Temporarily restricted net assets":2900},"Form990Details":{"program_service_accomplishments":[{"description":"THE FOUNDATION USES CONTRIBUTIONS TO FUND RESEARCH FOR PEDIATRIC CANCER DRUGS, INCLUDING UDERWRITING A LAB AT MEMORIAL SLOAN KETTERING CANCER CENTER, AND ALSO FINANCIALLY SUPPORTS LOW INCOME FAMILIES AND MILITARY FAMILIES WHO HAVE CHILDREN WITH CANCER. Of particular significance in 2014 was the case of josh hardy. Josh had experienced four bouts of kidney cancer from the age of 9 months and in january, 2014, at the age of 7, had a bone marrow transplant which resulted in his being diagnosed in mid-february with a life threatening adenovirus given his immune system was totally compromised. Chimerix continued to decline the request by josh's treating doctors to give josh the drug consistent with its having declined since 2012 over 300 prior requests by terminally and seriously ill patients. Mcf agreed on march 7, 2014, to attempt to get the drug for josh which hopefully would save his life. Ultimately, due primarily to the efforts of mcf, josh on march 12, 2014 received the drug, which is credited with saving his life. When the former ceo of chimerix is asked what distinguished josh hardy from the over 300 requests by seriously and terminally ill patients that the company declined, he advised that he answers in two words, referring to the foundation's vice-chairman, \"richard plotkin.\" josh's health continued to improve 2.5 years following his being given the drug although he had recently encountered what appeared to be serious health issues. Sadly, though, on september 22, 2016, josh, at age 10, succumbed to the cancer that had afflicted him for his entire life. In 2014, mcf's vice president, richard plotkin, was appointed to an advocacy committee dealing with the white house on issues relating to pediatric cancers. He has also been interviewed on national public radio (npr) and on cbs radio regarding his role in the josh hardy matter. In addition, richard has been invited to participate in panel discussions at various industry conferences and has been a featured speaker at other times to various audiences, all of which dealt with his efforts to save the life of josh hardy and how his efforts were successful when those of over 300 prior patients' requests for brincidofovir were denied. 8. The foundation in november 2015 filed a lawsuit that was later amended in march 2016 with the filing of a first amended complaint against a former employee, taylor van deusen, program director for the foundation from january 1, 2012 through her termination for cause in september 2015 (the \"lawsuit\"). The foundation in the lawsuit asserts causes of action for conversion, fraud, breach of duty of loyalty, disgorgement of salary and benefits, and unjust enrichment. The lawsuit was filed in the superior court of new jersey, bergen county, docket no. Ber-l-10170-15. Included in the lawsuit as additional defendants are ms. Taylor van deusen's mother, wendy van deusen, and ms. Taylor van deusen's wedding planning companies, duke + van deusen events, llc, and tailored productions. Dismissed without prejudice from the lawsuit was longhouse reserve for lack of personal jurisdiction over that defendant which is a 501(c)(3) non-profit located in new york state that the new jersey court held cannot be sued in new jersey due to its lack of sufficient contacts with that state. The foundation asserts in the lawsuit that while employed by it, ms. Taylor van deusen stole at least $29,000 from january 2012 through august 2015. Ms. Taylor van deusen in september 2015 reimbursed the foundation for those monies stolen by her in 2015 a total $6,582.94 moreover, the foundation alleges in the lawsuit that ms. Taylor van deusen stole gift cards intended to be sent to low income and military families from march 2014 through july 2015 in the estimated sum of $30,100. The foundation also asks the court to enter a judgment against ms. Taylor van deusen for over $244,000 representing the salary and benefits received by her from the foundation prior to the termination of her employment in september 2015. The foundation seeks damages in the lawsuit not only against ms. Taylor van deusen but also against ms. Wendy van deusen (who the foundation asserts received goods purchased with stolen funds) and against the wedding planning companies (duke + van deusen events, llc, and tailored productions) which, as alleged by the foundation, received benefits from stolen funds.
