programs.\n\n2010 program reorganization of youth services agency (ysa) and a related organization youth services agency of pennsylvania (ysa of pa). In response to a meeting in 2009 with the deputy secretary of pa dept. Of public welfare, office of the children, youth & families, (dpw/ocye) we reorganized the programs of these two inter-related non-profit corporations. Historically, these companies provided an integrated range of juvenile justice, education, and therapeutic social services to at risk and delinquent youth. Services are provided through both residential and in- home or community settings to 750 to 1,000 youth per year amoung 12 programs and 24 locations. Background - all services were originally funded through the pa act 148funds which support publicly mandated services for dependent and delinquentyouth in pa. Services we provided included both residential care, education, community services, restitution and vocational training, as well as clinical services such as individual and group counseling and behaviorial support services. Pa dpw/ocyf at one time funded all these \"blended\" programs under act 148, but gradually has eliminated education and clincial services from act 148 reimbursement. All youth that are court ordered to state licensed residential care have their health care funded by medical assistance (ma) and in the last decade, all clinical and treatment services were required by dpw to be funded through ma. Similarly, all educational services once funded through act 148 are now required to be funded though the pa dept of education. In response to these changing requirements, ysa split into 2 non-profit corporations in 2005 to provide separate accounting and segregation of mandated services funded by different funding streams. Ysa operates 2 residential and 7 community alternative (day) schools that are funded by contracts with local school districts under the alternative education for disruptive youth (aedy) program of the pa dept of ed. Dpw encouraged ysa to further pursue ma funding for the mandated clinical services in our residential programs. However, ma, under behavioral health accreditation standards, will not approve a component clinical program of a larger program entity, but only approve the entire legal entity. Therefore, residential programs must be funded as either entities under the residential treatment facility (3810) and act 148 regulations of juvenile courts in pa, or as entities under \"behavioral health\" funding managed by ma regulation. Both residential care under act 148 and treatment services under ma are mandated but must be organized into separate legal entities. Ma and act 128 have conflicting purposes and requirements. Under the juvenile act that defines act 148 services, judges court order the admission of delinquent youth for the care and protection of both the youth and the community, while under behavioral health regulations, only the medical necessity of services are considered to approve admission of youth, as judged by an approved health care professional. The needs of public safety or the need to provide custodial security of the offender are not considered which greatly affects critical issues like length of placement, patient rights, etc. Further adding to this conflicting complexity, the newer restortive justice additions to the juvenile act require juvenile justice goals of the restoration of the victim and community. For the offender, the provision of skills is required, which is an education based mandate. In summary, to provide all required services now, a provided must have multiple legal entities (e.g. Non-profits) separately funded by ma, dpw or the dept of education. If anything, this brief summary is a understatement of the complexities involved in providing all mandated juvenile justice services today. In the spring of 2009 the board of each non-profit realigned all programs under these two legal entities (ysa and ysa of pa) to allow our programs to have separate funding streams and accounting and expense segregation for the reasons just reviewed. In short, the oldest entity, was primarily a clinical casework provider and all ma and educations programs were placed under that non-profit. In 2010, ysa became ma funded for school based clinical services required under \"special education\" requirements of the pa dept. Of ed. At our two residential schools. There is a linkage of our ma and educational programs, both are school based.
