Ten-percent support limitation. An organization \"normally\" receives the requisite amount of public support and meets the Test for a taxable year and the taxable year immediately succeeding that year, if, for the taxable year being tested and the four taxable years immediately preceding that taxable year, the organization meets the facts and circumstances test on an aggregate basis. The Institute's percentages for the four taxable years immediately preceding this year are 16.72%, 34.81%, 54.07% and 57.64%. Its public support percentage for the current taxable year is 6.27% . The Institute's operations as described herein have not changed throughout this time period or since the Institute's inception. Accordingly, the Institute normally receives the requisite amount of public support and meets the Test on an aggregate basis. Attraction of public support. The Institute is organized and operated to attract new and additional public or governmental support on a continuous basis. The Institute meets this requirement because it carries on activities designed to attract support from governmental units, social service agencies, faith-based institutions, educational organizations and other publicly supported charitable organizations. The Institute is part of a group of affiliated tax-exempt, not-for-profit corporations that, together, form one of New York City's largest providers of transitional housing and social services to homeless families (the \"Network\"). The Network includes the following not-for-profit organizations, all of which are tax-exempt public charities: the Institute, Homes for the Homeless, Inc., Homes for the Homeless Summer Camps, Inc., Senior Isle Inn, Inc. and 521 West 49th Street Housing Development Fund Corporation. As their names suggest, these organizations are dedicated to providing shelter and meeting the basic social service needs of low-income, elderly and/or homeless families. Since its inception, the Institute has worked in close association with the other entities in the Network conducting quantitative and qualitative research to develop unique strategies to combat homelessness. The Network uses the Institute's research findings to respond to changing trends and policies impacting homeless children and families in a timely and effective manner. The Institute and the other entities in the Network work extensively with New York State and City governmental agencies, including the New York State Office of Children and Family Services, the New York City Department of Homeless Services, the New York City Administration for Children's Services, the New York City Department of Youth and Community Development and the New York City Department of Housing Preservation and Development, that provide much of the funding for the Network's activities. The Institute owns all of the real property in the Network. Services are provided in these properties free of charge to residents of the homeless shelters; the Network is paid for such services under contracts with New York City governmental agencies. Accordingly, the Institute carries on activities designed to attract support from governmental units and other publicly supported organizations. In addition, the Institute satisfies the following facts and circumstances, which are taken into consideration in determining whether an organization is publicly supported for purposes of the Test. Availability of public facilities or services; public participation in programs or policies. The Institute, as an organization serving homeless families of New York City, provides facilities and facilitates the provision of services directly for the benefit of the general public on a continuing basis. The Institute also is a research institution that regularly publishes public policy and scholarly studies that are widely used by government agencies, social service organizations, colleges and universities, and members of the general public. The Institute's social science policy research examines the growing prevalence of child and family homelessness in America, and analyzes nationwide trends across all 50 states as well as local case studies in individual communities. The Institute's goal is to produce and disseminate, free of charge, evidence-based, action-oriented research that will educate the public, engage service providers, and influence public policy. In addition to published research, Institute scholars write articles for peer-reviewed journals, and present their research to audiences of academics, service providers, and policy makers at local and national conferences across the country. The Institute also fosters a national dialogue by drawing leaders in the field of family homelessness to regularly held symposia. The Institute's American Almanac of Family Homelessness is a rich print and online resource for service providers, advocates, researchers, and policy makers working in the field of family homelessness. The website provides a state-by-state snapshot of the interconnections between government and nonprofit work to end family homelessness. Users can navigate the Web site to gain a deeper understanding of how family homelessness varies across the 50 states. The Institute also publishes \"UNCENSORED: American Family Experiences with Poverty and Homelessness\" three times per year. This free magazine, written for a broad audience, provides on-the-ground reporting from around the country on how poverty and homelessness have affected families and communities. The Institute's peer-reviewed Journal of Children & Poverty (JCP) is another widely available resource that provides original research on education, health, public policy, and the socioeconomic causes and effects of poverty. JCP seeks papers that will influence policy and practice in the fields of child and family welfare, and targets an audience that includes policy makers, academics, and community leaders. The Institute also has created a series of children's books and accompanying curriculum about homelessness, as well as a catalogue of posters to raise public awareness about the issue of child homelessness. The Institute distributes these materials at no or low cost to schools, libraries, social service agencies, community based organizations, houses of worship and homeless shelters throughout New York City and in other parts of the country. Finally, the Institute maintains a definitive program to accomplish its charitable work in the community, and a significant part of its funds derive originally from a governmental agency with which other members of the Network contract and to which the members of the Network are held accountable as a condition of such contracts. for the Homeless Institute 10% Facts and Circumstances Test Homes for the Homeless Institute, Inc. (the \"Institute\") continues to qualify as a publicly supported organization under the facts and circumstances test (the \"Test\") set forth in Treas. Reg. Section 1.170A-9(f)(3), as follows: The Institute normally receives a substantial part of its support from governmental units, from contributions made directly or indirectly by the general public, or from a combination of these sources, and meets the ten percent support limitation and the attraction of public support test. In addition, the Institute is in the nature of an organization that is publicly supported, taking into account all pertinent facts and circumstances, as set forth herein. Ten-percent support limitation. An organization \"normally\" receives the requisite amount of public support and meets the Test for a taxable year and the taxable year immediately succeeding that year, if, for the taxable year being tested and the four taxable years immediately preceding that taxable year, the organization meets the facts and circumstances test on an aggregate basis. The Institute's percentages for the four taxable years immediately preceding this year are 16.72%, 34.81%, 54.07% and 57.64%. Its public support percentage for the current taxable year is 6.27% . The Institute's operations as described herein have not changed throughout this time period or since the Institute's inception. Accordingly, the Institute normally receives the requisite amount of public support and meets the Test on an aggregate basis. Attraction of public support. The Institute is organized and operated to attract new and additional public or governmental support on a continuous basis. The Institute meets this requirement because it carries on activities designed to attract support from governmental units, social service agencies, faith-based institutions, educational organizations and other publicly supported charitable organizations. The Institute is part of a group of affiliated tax-exempt, not-for-profit corporations that, together, form one of New York City's largest providers of transitional housing and social services to homeless families (the \"Network\"). The Network includes the following not-for-profit organizations, all of which are tax-exempt public charities: the Institute, Homes for the Homeless, Inc., Homes for the Homeless Summer Camps, Inc., Senior Isle Inn, Inc. and 521 West 49th Street Housing Development Fund Corporation. As their names suggest, these organizations are dedicated to providing shelter and meeting the basic social service needs of low-income, elderly and/or homeless families. Since its inception, the Institute has worked in close association with the other entities in the Network conducting quantitative and qualitative research to develop unique strategies to combat homelessness. The Network uses the Institute's research findings to respond to changing trends and policies impacting homeless children and families in a timely and effective manner. The Institute and the other entities in the Network work extensively with New York State and City governmental agencies, including the New York State Office of Children and Family Services, the New York City Department of Homeless Services, the New York City Administration for Children's Services, the New York City Department of Youth and Community Development and the New York City Department of Housing Preservation and Development, that provide much of the funding for the Network's activities. The Institute owns all of the real property in the Network. Services are provided in these properties free of charge to residents of the homeless shelters; the Network is paid for such services under contracts with New York City governmental agencies. Accordingly, the Institute carries on activities designed to attract support from governmental units and other publicly supported organizations. In addition, the Institute satisfies the following facts and circumstances, which are taken into consideration in determining whether an organization is publicly supported for purposes of the Test. Availability of public facilities or services; public participation in programs or policies. The Institute, as an organization serving homeless families of New York City, provides facilities and facilitates the provision of services directly for the benefit of the general public on a continuing basis. The Institute also is a research institution that regularly publishes public policy and scholarly studies that are widely used by government agencies, social service organizations, colleges and universities, and members of the general public. The Institute's social science policy research examines the growing prevalence of child and family homelessness in America, and analyzes nationwide trends across all 50 states as well as local case studies in individual communities. The Institute's goal is to produce and disseminate, free of charge, evidence-based, action-oriented research that will educate the public, engage service providers, and influence public policy. In addition to published research, Institute scholars write articles for peer-reviewed journals, and present their research to audiences of academics, service providers, and policy makers at local and national conferences across the country. The Institute also fosters a national dialogue by drawing leaders in the field of family homelessness to regularly held symposia. The Institute's American Almanac of Family Homelessness is a rich print and online resource for service providers, advocates, researchers, and policy makers working in the field of family homelessness. The website provides a state-by-state snapshot of the interconnections between government and nonprofit work to end family homelessness. Users can navigate the Web site to gain a deeper understanding of how family homelessness varies across the 50 states. The Institute also publishes \"UNCENSORED: American Family Experiences with Poverty and Homelessness\" three times per year. This free magazine, written for a broad audience, provides on-the-ground reporting from around the country on how poverty and homelessness have affected families and communities. The Institute's peer-reviewed Journal of Children & Poverty (JCP) is another widely available resource that provides original research on education, health, public policy, and the socioeconomic causes and effects of poverty. JCP seeks papers that will influence policy and practice in the fields of child and family welfare, and targets an audience that includes policy makers, academics, and community leaders. The Institute also has created a series of children's books and accompanying curriculum about homelessness, as well as a catalogue of posters to raise public awareness about the issue of child homelessness. The Institute distributes these materials at no or low cost to schools, libraries, social service agencies, community based organizations, houses of worship and homeless shelters throughout New York City and in other parts of the country. Finally, the Institute maintains a definitive program to accomplish its charitable work in the community, and a significant part of its funds derive originally from a governmental agency with which other members of the Network contract and to which the members of the Network are held accountable as a condition of such contracts. Representative governing body. The Institute has a governing body that represents the broad interests of the public, rather than the personal or private interests of a limited number of donors. The Institute's Board of Directors is comprised of six individuals with special knowledge or expertise about the problem of homelessness in New York City and who represent a broad cross-section of the views and interests of the New York city community.
